Why India, Specifically

Trademark rights in India are territorial — a registration you hold in the US, EU or elsewhere gives you no automatic protection here. If you’re entering the Indian market, filing locally is a separate, necessary step, not a formality layered on top of an existing mark.

India Runs “First-to-File”

Unlike some jurisdictions, prior use isn’t enough on its own to secure priority — whoever files first, and successfully defends the application, generally wins the mark. That makes early filing a genuine competitive move, not just paperwork.

Realistic Timelines

An uncontested trademark can register in roughly 12–18 months; one that draws an objection or opposition often takes longer. Patents typically run several years given examination queues. Copyright registration is comparatively fast, usually a few months.

Common questions about trademark & IP filing

I already hold a trademark in my home country — do I still need to file in India?

Yes. Trademark protection is territorial, so a registration abroad grants no automatic rights in India. You’ll need a separate Indian filing, though your existing registration can sometimes support the application in limited ways.

What’s the difference between TM and the ® symbol?

The “TM” symbol can be used the moment you’re using a mark commercially, even before registration is complete, as a general notice of a claimed trademark. The “®” symbol legally may only be used once the mark is formally registered with the Trade Marks Registry.

What happens if someone opposes my trademark application?

During the journal publication window, any third party can file an opposition. We handle the counter-statement and represent you through the opposition proceedings — most applications that reach this stage still register, but the timeline extends.

Should I file a patent before or after launching my product?

Before, wherever possible. Public disclosure — including a product launch — before filing can jeopardize novelty, which is a core requirement for patentability. A provisional filing is a fast, low-cost way to lock in a priority date ahead of launch.

Is copyright registration mandatory for my software or designs?

No — copyright exists automatically the moment an original work is created. Registration isn’t mandatory, but it creates a dated, official record that becomes valuable evidence if you ever need to prove ownership in a dispute.
