Objections answered in days Not weeks

Common trademark filing mistakes

Descriptive Names

Marks that describe the product or its quality draw Section 9 objections.

Skipping the Search

Filing without checking similar marks invites Section 11 objections and oppositions.

Wrong or Vague Class

Wrong classes or vague descriptions leave your real business unprotected.

Claiming Use Without Proof

A prior use date needs a user affidavit and evidence, or it’s treated as proposed use.

Missing the Reply Deadline

No reply within one month can lead to abandonment.

Using ® Too Early

® before registration is an offence. Use ™ until the certificate is issued.

Quick Answers

Common questions about trademark registration

The application is filed and gets its number straight away, and you can use the ™ symbol from then. Registration itself goes through examination, any objection reply or hearing, advertisement in the Trade Marks Journal and a 4-month opposition period, so it typically takes several months, and longer if there are objections or an opposition. The ® symbol can be used only after registration.
The government fee for Form TM-A on e-filing is ₹4,500 per class for individuals, startups and small enterprises, and ₹9,000 per class for others. Physical filing costs ₹5,000 and ₹10,000. Professional fees are separate.
No one can get a registration certificate in 15 days, because the law requires examination, advertisement and a 4-month opposition period. What can happen quickly is filing: your application number is issued on filing and you can use ™ immediately. Expedited examination (₹20,000 or ₹40,000 per class) speeds up the examination stage, which IP India aims to complete within about three months.
Under Rule 34 of the Trade Marks Rules, 2017, you can request expedited processing by e-filing for ₹20,000 per class (individuals, startups, small enterprises) or ₹40,000 (others). The examination is ordinarily done within three months of the request, but the opposition period after advertisement stays four months.
You can use ™ as soon as your application is filed. You can use ® only after the trademark is registered. Using ® on an unregistered mark is an offence under the Trade Marks Act.
The applicant’s name, address and legal status (individual, firm, company, LLP), the brand name or logo, the goods or services, the date of first use if already used (with a user affidavit and evidence), and a power of attorney (TM-48) if an agent files. Startups and MSMEs add their recognition or Udyam certificate for the lower fee.
One class per category of goods or services you sell or plan to sell soon. A clothing brand files in Class 25; if it also runs an online store, Class 35 too. Each class has its own government fee.
Ten years from the application date, renewable every ten years on Form TM-R for ₹9,000 per class (e-filing).
To find identical or similar marks already filed in your class. A conflicting earlier mark is the most common reason for objections and oppositions, so a good search and choice of mark saves months.
Yes, directly with an Indian address for service, or through the Madrid Protocol designating India. We act as the Indian address for service and handle replies and hearings.
