Common patent mistakes

Public Disclosure Before Filing

Showing or selling the invention before filing can destroy novelty. File first.

Weak Claims

Claims that are too narrow are easy to design around; too broad and they’re rejected.

Missed 12-Month Deadline

No complete specification within 12 months of a provisional means abandonment.

Forgetting Form 18

No examination request within 31 months and the application is treated as withdrawn.

Quick Answers

Common questions about patent registration

Check novelty with a prior-art search, file a provisional or complete specification with Form 1 at the Indian Patent Office, file the complete specification within 12 months of a provisional, request examination on Form 18, reply to the First Examination Report and attend any hearing. If the invention meets the requirements, the patent is granted for 20 years from filing.
On e-filing, Form 1 costs ₹1,600 for natural persons, startups, small entities and educational institutions, and ₹8,000 for others. Request for examination (Form 18) costs ₹4,000 or ₹20,000, and expedited examination (Form 18A) ₹8,000 or ₹60,000.
For applications filed on or after 15 March 2024, Form 18 must be filed within 31 months of the priority or filing date, whichever is earlier. Earlier applications keep the 48-month deadline. Without a request, the application is treated as withdrawn.
A provisional specification describes the invention without full claims. It secures your filing date while you develop the invention, but the complete specification must be filed within 12 months or the application is treated as abandoned.
It varies by field and backlog. Normal examination can take a few years from request; expedited examination under Form 18A for startups and other eligible applicants is much faster. A strong specification and quick FER replies shorten the process.
Twenty years from the filing date, subject to paying renewal fees from the third year.
Key changes from 15 March 2024: request for examination within 31 months (down from 48), working statements once every three financial years, a new certificate of inventorship (Form 8A), a fee for pre-grant opposition, a 10% renewal fee reduction for advance payment of four or more years, and divisional applications from provisional or complete specifications.
Computer programmes ‘per se’ aren’t patentable under Section 3(k), but inventions that use software and produce a technical effect or contribution may be. Claims must be drafted carefully around the technical solution.
Government fees for a DPIIT-recognised startup are the reduced ones: ₹1,600 to file and ₹4,000 to request examination, or ₹8,000 for expedited examination. Search and drafting are professional costs, which we quote in advance.
