Objections Explained

Why trademark objections happen

Absolute Grounds

Section 9: the mark is descriptive, non-distinctive, customary, deceptive, offensive, uses protected emblems or covers a functional shape.

Relative Grounds

Section 11: the mark is identical or similar to an earlier mark for similar goods or services, or to a well-known mark.

Procedural Issues

Vague specifications, wrong class, missing user affidavit or power of attorney, or incomplete applicant details.

Template Replies

Generic replies that don’t address the cited marks or section are often rejected.

Missing the Hearing

Not appearing at a show cause hearing can lead to the application being abandoned.

Ignoring the Journal

Quick Answers

Common questions about trademark objection reply and hearing

A trademark objection is raised by the Trade Marks Registry in the examination report when it sees a reason the mark shouldn’t be registered as filed, such as being descriptive or non-distinctive (Section 9) or similar to an earlier mark (Section 11), or a procedural defect. The status on IP India shows ‘Objected’.
One month from receipt of the examination report. If no reply is filed, the Registrar can treat the application as abandoned, so act as soon as the report is issued.
No. Replies to examination reports and show cause hearings carry no official fee.
If the Registrar accepts the reply, the mark is accepted and advertised in the Trade Marks Journal. If not, a show cause hearing is scheduled, where you or your agent argue the case. After the hearing the mark is accepted, accepted with conditions, or refused.
Yes. IP India publishes hearing cause lists and holds hearings through virtual hearing rooms, so we attend for clients anywhere in India.
By showing the marks are different overall, the goods or services aren’t similar, your use is honest and concurrent, or the cited mark isn’t a real obstacle (for example, abandoned or with a different scope). Evidence of your own use, sales and reputation helps a lot.
By showing the mark is distinctive for your goods, isn’t a direct description, or has acquired distinctiveness through use, supported by sales figures, advertising, invoices and market recognition.
You can ask for the grounds of decision on Form TM-M within 30 days of the decision, and then appeal to the High Court. We assess whether an appeal, a fresh filing or a modified mark is the better route.
After the mark is advertised in the Trade Marks Journal, anyone can oppose it within four months on Form TM-O. The applicant must file a counter-statement within two months, or the application is treated as abandoned. Evidence and a hearing follow.
