Common EPR mistakes

Selling Before Registration

Unregistered producers can face environmental compensation and can’t legally place products on the market.

Wrong Base Data

Targets are calculated from sales or import data. Errors carry into every year’s obligation.

Buying Certificates Late

Certificate prices and availability tighten near deadlines. Plan through the year.

Missing Returns

Late or missing returns can bring compensation and suspension of portal access.

Missing Third-Party Brands

Brands that only blend or relabel bought-in base oil are still producers.

One Product, Several EPRs

Quick Answers

Common questions about used oil EPR authorization

Extended Producer Responsibility for used oil, added to the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 by the Second Amendment Rules, 2023 (18 September 2023), in force from 1 April 2024. Producers of base and lubricating oil must ensure a share of what they sell is recycled.
Producers (manufacturers of base or lubricating oil, brands selling lubricants made from bought-in base oil, and importers of base or lubricating oil), importers of used oil, collection agents and recyclers. Bulk generators of over 100 tonnes a year must hand used oil to registered agents or recyclers.
Producers start at 5% for FY 2024-25 (based on 2022-23 sales) rising to 40% for 2029-30. Importers of used oil carry 100% of the previous year's imports.
Through re-refining or other permitted recycling, by buying EPR certificates from registered recyclers. Certificates are valid for two years from the end of the financial year they were generated in.
₹10,000 to ₹15 lakh per contravention, plus ₹10,000 per day for continuing contraventions, for false information, false certificates or wilful violations, along with environmental compensation for missed targets.
